Tolo Finds Digital Platform
This Agreement contains the complete Terms of Use that apply to your access to and use of the {{ config('app.name', 'Tolo Finds') }} digital platform ("Tolo Finds", "we", "us", or "the Platform Operator") and supersedes prior informal statements regarding platform use, except where a separate written agreement expressly applies.
These Terms take effect on the date of publication on the Platform. By registering for, accessing, or continuing to use Tolo Finds, you make an affirmative statement that you have read, understood, and accepted these Terms, our Privacy Policy, and any other applicable policies published by Tolo Finds.
If you do not agree, or if you are not legally eligible to use the Service, you must not access or use the Platform.
2.1 Tolo Finds operates a digital service marketplace that allows Customers to discover, request, schedule, and communicate with independent Service Providers, and allows Service Providers to offer and manage services.

2.4 Service agreements for work performed are primarily between Customers and Service Providers. Tolo Finds may facilitate communication, verification, scheduling, or payments as a technology intermediary.
2.5 Tolo Finds may modify, improve, suspend, or discontinue features (including free or paid features) at any time for operational, technical, regulatory, or business reasons. Temporary interruptions, maintenance, or outages may occur.
3.1 The Platform is provided on an "as available", "as is", and "with all faults" basis, to the maximum extent permitted by applicable law.

3.4 Users are responsible for personal safety and reasonable precautions during in-person service engagements. Tolo Finds is not responsible for losses, damages, injuries, disputes, or incidents arising from Customer–Provider interactions unless caused by Tolo Finds's proven negligence.

4.4 Tolo Finds may reject, limit, suspend, or revoke registration at its discretion if requirements are not met, verification fails, fraud is suspected, or Platform integrity is at risk.
4.5 You are responsible for keeping registration details up to date. Tolo Finds may request additional information at any time; failure to provide it may result in limited access, suspension, or termination.
4.6 You are responsible for confidentiality of Credentials. Activity on your Account is treated as your responsibility unless unauthorized access is promptly reported to Tolo Finds.
4.7 You must immediately notify Tolo Finds if you suspect unauthorized access, misuse, or compromise of your Account. Tolo Finds is not responsible for losses resulting from your failure to protect Credentials.
4.8 Tolo Finds may treat successful authentication (correct OTP/PIN/password) as performed by the legitimate Account holder and may regard subsequent Transactions as validly authorized by you, subject to applicable law.
5.1 After activation, and subject to eligibility, you may (as available):
5.2 Tolo Finds does not warrant that all functionalities will be available at all times and may withdraw or change functionality due to law, regulation, policy, security, or operational need.
5.3 Where Tolo Finds integrates third-party payment, messaging, maps, or other services, your use of those services may also be subject to the third party's terms. You agree to indemnify Tolo Finds against losses arising from your misuse of such external services, except to the extent caused by Tolo Finds's proven negligence.
5.4 Tolo Finds may vary these Terms or related policies. Changes become effective when published on the Platform. Continued use after publication constitutes acceptance. Users should review Terms and the Privacy Policy regularly.
6.1 Service Providers must provide accurate, complete, and current information, including identity/business details, categories, descriptions, pricing, coverage area, licenses/certifications where required, and verification documents.
6.2 Service Providers are solely responsible for:

6.4 Tolo Finds may review, restrict, suspend, or remove listings or provider profiles that violate these Terms or harm trust and safety.
7.1 A Booking may include category, description, preferred time, location, and instructions. Submitting a Booking does not guarantee acceptance or completion.
7.2 Customers must provide accurate requirements, location, contact details, and access arrangements.
7.3 Scope, fees, materials, timeline, and payment arrangements for the underlying service are primarily agreed between Customer and Service Provider, subject to any Platform rules shown at checkout or in-app.
7.4 Customers must not submit false requests, misuse contact information, request illegal services, harass Providers, or engage in fraud.
8.1 Tolo Finds may offer free and paid features, including subscriptions, commissions, featured placement, advertising, transaction fees, and other value-added services.
8.2 Applicable fees, methods, and terms will be communicated through the Platform. Tolo Finds may introduce, modify, or discontinue fees at its discretion, with notice where required by law or published fee schedules.
8.3 Service Providers are responsible for paying fees associated with using Tolo Finds paid features.
8.4 Unless required by law or expressly stated by Tolo Finds, payments for digital Platform fees are generally non-refundable.
8.5 Where Tolo Finds facilitates digital or mobile-money payments between Users, Tolo Finds may act only as a technology facilitator or payment intermediary. The underlying service Transaction remains between Customer and Service Provider.
8.6 You are responsible for ensuring sufficient balance/funds and accurate payment details. Failed, delayed, or incomplete payments may cancel or delay Bookings.
8.7 Tolo Finds may prescribe transaction limits and may reverse or hold Transactions where there is manifest error, suspected fraud, duplicate payment, chargeback, or legal requirement, subject to applicable law.
By using Tolo Finds, you represent that:

10.1 Tolo Finds collects and processes Personal Information to operate Accounts, Bookings, verification, support, security, and Platform improvement, as described in the Privacy Policy.
10.2 By using Tolo Finds, you acknowledge that some Personal Information may be shared with the other party to a Booking (for example contact or location details needed to perform the service), and with processors needed to operate payments, hosting, messaging, or analytics, under appropriate safeguards.
10.3 Tolo Finds may verify identity information through lawful sources and may disclose information to competent law enforcement or regulators where required to prevent fraud, money laundering, or other crimes.
10.4 Details of collection, use, retention, and your rights are set out in the Privacy Policy, which forms part of your agreement with Tolo Finds.
11.1 Tolo Finds (and its licensors) own Platform IP, including brand, logo, apps, website, software, design, and systems. Unauthorized use is prohibited.
11.2 Users retain ownership of Content they submit, but grant Tolo Finds a non-exclusive right to use, display, reproduce, and distribute such Content to operate, promote, and improve the Platform.
11.3 Users warrant that submitted Content does not infringe third-party rights. Infringement notices may be sent via support channels.
11.4 Users are solely responsible for Content they submit. Tolo Finds does not guarantee accuracy or reliability of User Content.
12.1 Disputes between Customers and Service Providers about delivery, pricing, quality, damages, delays, or agreements shall primarily be resolved between those parties.
12.2 Tolo Finds may provide reasonable support or mediation assistance but is not automatically a party to such disputes and is not obligated to resolve every dispute in a User's favor.
You agree to indemnify and hold harmless Tolo Finds, its owners, directors, employees, representatives, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
Tolo Finds may assume control of defense of matters requiring indemnification.
14.1 Tolo Finds will use reasonable efforts to process requests in a timely manner but does not warrant continuous, uninterrupted, or secure access. Service may be affected by factors outside Tolo Finds's control or by maintenance and upgrades.
14.2 To the maximum extent permitted by law, Tolo Finds is not liable for:
14.3 Users use the Platform at their own discretion and risk and are responsible for evaluating Providers and service requirements.
14.4 Tolo Finds's maximum aggregate liability for any claim arising from Platform use shall not exceed the amount you paid to Tolo Finds for Platform fees during the six (6) months preceding the event giving rise to the claim, unless a higher amount is required by applicable law.
15.1 Tolo Finds may suspend, restrict, freeze, or terminate Accounts (wholly or partly) if you violate these Terms, provide false information, engage in fraud or misuse, threaten safety/trust, or for compelling legal or security reasons.
15.2 Tolo Finds may be compelled by law to freeze an Account or decline Transactions if there are reasonable grounds to suspect criminal or fraudulent activity.
15.3 You may request Account closure through support channels, subject to resolution of open Bookings, disputes, fees, or legal holds.
15.4 Tolo Finds may close an Account upon reasonable notice where practicable, except where immediate action is required for security, fraud, or legal compliance.
15.5 Upon death or legal incapacity of a User, Tolo Finds may suspend Account activity until presented with lawful documentation authorizing access under Ethiopian law.
Neither party is liable for delay or failure to perform due to circumstances beyond reasonable control, including natural disasters, government restrictions, war/civil disorder, labor disputes, internet or power failures, system outages, or third-party service failures. If such delay continues for an extended period, either party may terminate affected obligations by notice, without prejudice to accrued rights.
17.1 These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia.
17.2 Disputes should first be raised with Tolo Finds Support and addressed through good-faith discussion and mediation.
17.3 If unresolved, disputes shall be handled by competent Ethiopian courts or arbitration mechanisms recognized under Ethiopian law.
